The choice has been to ban these people's Xbox 360s based on its console ID, not the player's Xbox Live account.
So, I guess if you want to go buy an Xbox again, you can start playing again?
So, what is going to happen:
1. Banned player sells banned Xbox 360 on Ebay.
2. New player signs up for the totally cool Xbox Live service that he heard so much about.
3. Gets bounced.
4. Calls Xbox Live Customer Service.
5. What will Microsoft do?
A. Reinstate the machine? B. Tell the person "tough luck"? C. Both, at random.
If they reinstate the box, this opens up the lazy circumvention strategy of skipping that whole "sell on eBay" thing and just try to get reinstated.
If they tell the person "tough luck"... Microsoft is going to have an UGLY CUSTOMER RELATIONS PROBLEM (followed by some nasty stories in the news) which should lead back to Answer A.
Even stupider option for Xbox Customer service - tell the naive purchasing person to "fix" their Xbox so that it isnt' hacked anymore.
I tend to argue strongly against banning. It is directly expensive and can have "highly entertaining" unforeseen consequences.
Also, if Microsoft hits "critical mass" with its banning activities, it may encourage the creation of a "guerrilla Xbox Live" that could spur further piracy.
What should Microsoft do?
That is at least a 3 beer question.

dude games aren't a necessity going pirated doesnt help anyone and on the bright side,ur only being banned from live where it wud be unfair to people who paid full price for the game and if u can pay 25k+ for a 360,what damage wud 2.5k games do? what a stupid comment you do know thhat companies make majority of its profits through software not hardware right??

+1 sanjoy...!! gr8 article...!! but im totally for bans..if u hack yr console, u shld be sure tht u cant play online.....this is what happens in pc games coz of the cd key and all....so y not the consoles also??

once MS ban the console, it can never get back on Xbox Live again, period. You can't call them up and go:
"Well, I flashed back to the original firmware, please unban me now."
Even those people who did not mod and got banned for whatever reason are being told that their console will have to be sent in and swapped. MS has also told quite a few that they are not showing as banned on their end, but if the customer can't access Xbox Live and they are getting the message, they cannot unban you over the phone, you still have to send in the console.

^^ totally agree with u as most pple on live have modded consoles.... saw a census somewhere sayin tht over 30-35% live users have got modified firmware ....
MS is stupid.... they thing tht with this firmware hack u can see thru walls in games like halo3 and shyt.... thts why the ban was simultaneous with the release on halo 3 beta ;(

arrey just because half the world is a pirate doesnt mean tht u shld not do anything to curb tht..!! whats wrong is wrong.... before buying the console only u guys knew tht this was bound to happen...everyday there were rumors and articles about it....and now tht it finally has, everybody is condeming it..!!
i think its a step in the rite direction....im not saying tht MS wins, coz the new firmware will be out and ppl will get tht asap....but still...atleast it gave some advantage to original users...

this may be a bad move by MS business-wise but i welcome it.....its about time companies stop making threats and start acting....sure the hackers will always come up with a new loophole, but by doing stuff like this MS will make it tougher for them and create uncertainty in a consumer's mind to a point where they will think twice about modding...i think its a great move by MS hopefully sony and nintendo will follow suit arjun™: doesnt matter if half the world does it...it doesnt make it right peace
